What We Do

Service That Survives a Motion to Quash

In Indiana, more service gets attacked on the paperwork than on the knock. We build the file so the paperwork holds.

A serve is not finished when the papers change hands. It is finished when opposing counsel cannot make the service itself the issue. In Indiana that bar is higher than most people expect, because the rules attach follow-up obligations to methods that look complete on their face.

Signature Serves & Investigations handles routine and difficult service of process for attorneys, firms, collection agencies, property managers, and insurers across Marion, Hamilton, Hendricks, Johnson, Boone, and Hancock counties.

The Four Ways to Serve an Individual in Indiana

Indiana Trial Rule 4.1(A) permits service on an individual by registered or certified mail (or another public means giving a written acknowledgment of receipt) to their residence, place of business, or employment with return receipt requested and returned showing receipt; by delivering a copy of the summons and complaint personally; by leaving a copy at their dwelling house or usual place of abode; or by serving their agent as provided by rule, statute, or valid agreement.

That first method is why Indiana practice differs so much from neighboring states. Certified mail is a legitimate primary method here, and most firms try it first. It works until it does not — the receipt comes back unclaimed, or signed by someone whose relationship to the defendant is unclear, and now there is a service problem sitting in the file. Most of our assignments arrive at exactly that moment.

The Rule 4.1(B) Step That Gets Missed

This is the single most common defect in Indiana service. When service is made by leaving a copy at the dwelling or by serving an agent, Rule 4.1(B) requires the person making service to also send a copy by first class mail to the address on the summons — and to show that mailing on the return. Copy service without the follow-up mailing, or with the mailing done but never documented, is exactly the gap a defense lawyer looks for.

We treat the mailing as part of the serve, not an afterthought. It goes out, it gets recorded, and it appears on the return. You should never have to ask us whether it happened.

Who Is Allowed to Serve in Indiana

Indiana does not license private process servers. Trial Rule 4.12 contemplates service by the sheriff or a deputy, by a person specially appointed by the court, and by law enforcement officers who agree to make service. The rule also provides that service is effective when made by a person not otherwise authorized — but in that case proof of service must be made by that person as a witness or by deposition.

That last sentence is the practical argument for using a professional. Service by a friend, a paralegal, or a party's relative may well be effective, and it may also mean putting that person under oath to prove it. A properly documented return from a disinterested professional server keeps the question from ever being raised.

What The Return Has To Say

Trial Rule 4.15 requires the return to be made promptly and to state the time, place, and manner of service. When service was not made, the return must explain the particular manner in which it was thwarted. That is a higher standard than “attempted, no answer” — and it is why every attempt we make carries a GPS stamp, a timestamp, and a contemporaneous note about what was actually observed at the door.

Questions

Frequently Asked

Straight answers to what Indiana firms ask us most about this service.

Do process servers have to be licensed in Indiana?

No. Indiana has no statewide licensing or registration scheme for private process servers. Trial Rule 4.12 contemplates service by the sheriff, a person specially appointed by the court, or a law enforcement officer who agrees to serve, and the rule further provides that service is effective even when made by someone not otherwise authorized — though in that case proof must be made by that person as a witness or by deposition. We are disinterested professionals and our returns stand on their own.

Can't I just use certified mail?

You can — Trial Rule 4.1(A)(1) makes registered or certified mail a legitimate primary method when the return receipt comes back showing receipt. The difficulty is what happens when it does not: unclaimed mail, a refused envelope, or a signature from someone whose relationship to the defendant is unclear. At that point you need personal or copy service, and most of our files arrive exactly there.

What is the Rule 4.1(B) mailing and why does it matter?

When service is made by leaving a copy at the dwelling or usual place of abode, or by serving an agent, Rule 4.1(B) requires the server to also send a copy by first class mail to the address on the summons and to show that mailing on the return. Skipping it, or doing it without documenting it, is the most common defect we see in Indiana service. We handle it as part of the serve, every time.

How many attempts do you make?

Three attempts are included as standard, deliberately scheduled at different times of day so a subject with a predictable routine does not miss all three. If three do not produce service, you get a return detailing how service was thwarted, which is what a court wants to see before authorizing an alternative method.

How long does service usually take?

Standard service is typically attempted within two to three business days, with most serves completed inside the first week. Rush and same-day options exist for filing deadlines and hearing dates that do not allow for that.

Do you serve outside Marion County?

Yes. Hamilton, Hendricks, Johnson, Boone, and Hancock counties are routine working territory, and we cover the wider central Indiana region on request.

How do I get the return?

Digitally through ServeManager and by email, normally the same day service is completed, stating time, place and manner as Rule 4.15 requires. Hard copies on request.
